In an advisory on Monday, Vermont’s Attorney General T.J. Donovan declared that businesses gifting free cannabis is illegal under the state’s new recreational marijuana law.

It seems some businesses were offering free marijuana in different forms in exchange for a delivery fee.

Entrepreneurs were even offering free marijuana on the side with the purchase of a t-shirt or sticker.

Donavan has declared this illegal and stated in the advisory, “Any transfer of marijuana for money, barter, or other legal consideration remains illegal under Vermont law.”

He added that “Individuals may gift pursuant to the parameters set forth in the law.”

Act 86 allows residents of the state to possess up to an ounce of marijuana and two mature and four immature cannabis plants. Act 86 also declares that consuming the drug in public is illegal as is driving under the influence of it.
