It was this week that Oklahoma made medicinal marijuana in the state legal, but some residents may not be happy to learn that they have to choose either the drug or their guns.

As the 30th state to legalize marijuana medicinally, Oklahoma has provided conditions that require residents who want a medicinal marijuana card to give up their guns.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) confirmed to ABC affiliate KOCO-TV this week that a 2011 open letter still stands that says federal law bans anyone who is an “unlawful user of or addicted to any controlled substance” from “possessing firearms or ammunition.”

According to the letter, anyone that uses the drug is an “unlawful user of” the controlled substance, and cannot own a gun.

“Using a controlled substance is a prohibitor, similar to being convicted of a felony offense,” Special agent with the ATF, Meredith Davis, told NBC affiliate KFOR-TV.

There is one way around it and that’s if a spouse requires medicinal pot for an illness, the other spouse can own a firearm. The person with the medicinal marijuana card is not allowed access to the weapon however.
